A – This form is attached to and forms part of the Rental Lease.
TERMS AND CONDITIONS FOR
RENTALS
Please call or e-mail to verify the
availability of the property you wish to rent. All reservations
must include a completed application form and rental agreement
plus rental fees or booking deposit to be processed. Once Sea &
Ski has received this information a confirmation letter will be
mailed to you. Once all rental funds are received plus security
deposit, a confirmation package will be sent to you. This
package will contain a map to the property, location of keys,
coming events and the house rules for that property.
1. Booking
Deposit
-
If booking more than
90 days in advance, there will be a deposit of one third of
your rental amount required.
-
Balance of rent must
be paid 90 days in advance.
-
If booking 90 days
or less, a credit card is required to hold the property
until full funds have been received by cheque.
-
Full funds are
required on the date expressed in the lease agreement by
cheque.
-
A security deposit
that is fully refundable is required for all rental
properties.
2. Security Deposit
For security purposes, a
damage deposit is required by one of two methods.
-
Provide a copy of
both sides of the credit card. (Your card will not be
utilised unless there are any damages or long distance
telephone charges).

Provide $1,000.00-
$2,000.00 (depending on property) dollars by cash, cheque
or credit card 2 weeks prior to arrival. Deposit refunds
will be returned by mail following check out. Properties
with telephones will be held for 40 days. Those without, 10
days.

If
damages/cleaning/violation of terms and conditions exceed
security deposit lease holder will be liable for monies owed
to owner of the rental property and Sea & Ski due to lack of
care on the renters part or disrespect to the property and
the leaseholder will be invoiced for the extra charges and
the credit card on file will be charged.
3. Cleaning
All properties require
departure-cleaning services. Guests are responsible for leaving
the property in good order before departure. Guest shall leave
all doors and windows locked and make sure lights are turned
off. Guest are required to complete before departure

Return furniture to original locations

Wash and put away all dishes including
those in dishwasher

Remove all food and trash from property
-
Place trash in sealed plastic bags
improper receptacle

Appliances, counters and other surfaces
must be wiped clean
IF extra cleaning is
required due to lack of care on the renters part or disrespect
of the property a $40.00/per hour clean up charge will apply as
well as the loss of the security deposit.
Plumbing must not be
used to dispose of rags, sweepings, sanitary napkins, tampons,
or other objects, nor shall it be used for any purpose than for
which is was designed, eg. Human waste & toilet paper. The guest
shall be liable for any damage to the plumbing, resulting from
misuse or abuse.
4. Methods of Payment
We accept rental
bookings by: Master Card, Visa, and Cheque
5. Cancellation Policy
-
Cancellations by the
renter must be made in writing to Sea & Ski.
-
If Sea & Ski is successful in re-booking
the rental vacation for the original amount, a refund will
be given to the renter less an administration fee of $75.00.
-
If Sea & Ski only re-books the rental
property for a portion of the rental period, a refund for
the amount received less an administration fee of $75.00
will be refunded to the renter.
6. Telephone
Charges
-
Use of property
telephones shall be for local calls only.
-
All long distance
calls should be charged to a calling card.
-
Long
distance calls made on the property telephone will be
deducted from the security deposit along with a $20.00
administration charge.
7. Occupancy
-
We prefer family
groups and mature qualified adults.
-
Every rental
property has an occupancy level that can not be exceeded.
-
If occupancy levels
are exceeded this will result in losing their security
deposit and termination of the rental agreement.
-
If guests plan to
have day guests or any other guest that may exceed the
occupancy level, Sea & Ski must be contacted prior to
arrival. Failure to do so will result in losing security
deposit and termination of the rental agreement.
8. Behaviour
-
Any misuse or abuse of the property
resulting in extra cleaning shall be charged to the renter
at $40.00/hr. Plus losing security deposit.

House parties and large gatherings
exceeding maximum occupancy are prohibited and may result in
guests immediate removal and loss of the security deposit.
No refunds due to eviction of property.

Guests are responsible for the actions of
their children and friends using the unit.
9. Check-in
Check-in must take place
at the designated Sea & Ski Realty office. Check-in is
4:00pm-no early check-ins. Late check-ins cannot be provided
if there is a balance due. Guests shall not proceed to
property prior to 4pm.Guests may be charged one additional
day if property is occupied prior to 4pm. Any discrepancies
including inventory sheets should be reported to the office as
soon as possible. Any damage and/or breakage should be reported
to the office before check-out.
10. Check-out
Check out and vacating
the property on day of departure is promptly at 10:00am.
Guests may be charged one additional day rental if property is
not vacated by check-out time. We have a short time to get units
ready for the next guest. Please do not ask staff to make
exceptions to this rule. If check-out time is not abided by we
may result in the loss of security deposit. All property keys
must be returned to the designated Sea & Ski Realty office.
There will be a $50.00 charge if the key is lost, missing or not
returned.
11. Pets
Most property owners
do not allow or accept pets due to
owner preference or allergy concerns. No pets are allowed
without Sea & Ski’s pet agreement signed in advance of arrival.
If there is evidence of a pet on the premises without Sea & Ski
being aware or a pet agreement being signed will result in loss
of security deposit and a $100.00 cleaning charge. If pets are
allowed, it is the pet owner’s responsibility.

To clean up after it, i.e: stoop and
scoop.

Keep your pet controlled and leashed on
rental property at all times.
-
Make sure of no disturbance at any time
i.e: barking
-
If
any carpets are soiled by the pet, the owner of the animal
will have the carpets professionally cleaned at their
expense
-
If
the pet should cause any damages to the rental property
furniture or fixtures the pet owner will repair or replace
at their own expense.
12.
Trash Removal
Guests are responsible
to place sealed, bagged and tagged when there are tags
required, trash in containers for weekly trash removal.
Failure to do so will result in loss of security deposit and a
$40.00/hour clean-up fee.
13.Items
not Supplied
The rental property will
not supply linens, towels,

Unforeseen Circumstances
Sea & Ski and the owner
are not liable for any acts of nature or major mechanical
failures that would prohibit or limit the use of a property. Sea
& Ski has no control over acts of god and will not provide
refunds in these circumstances.
15.
Insects/Rodents
In the country, cottages
are often visited by mice, squirrels, etc, insects that fly such
as black flies, house flies, mosquitoes and crawling insects
such as wood roaches and spiders. These creatures are a part of
nature. Precaution is taken to prevent these visitors from
entering the cottages. Often mother-nature circumvents all
man-made obstacles. Therefore Sea & Ski does not accept such
irritations as grounds for cancellation of a rental and/or a
refund of monies.
16.
Construction
We cannot predict when
or where new construction will begin. Sea & Ski has no control
in these situations and cannot move or offer refunds on
confirmed reservations if construction occurs near the property
being occupied for rental purposes.
17.
Subletting
Subletting is
prohibited. Subleasing shall
immediately void any rental agreement with no refund due to the
guest
18.
Quiet Hours
With respect to our
properties neighbours and surrounding community please respect
quiet times between 9pm-8am. Failure to do so will result in
termination of rental agreement and loss of security deposit. No
refunds.
19.
Parking
Parking is sometimes
limited at our properties. The number of vehicles prohibited or
parking by-laws of each property will be stated in our
confirmation. Excess vehicles may be towed at owners expense if
not in accordance with county and area laws. These will occur at
the vehicle owner’s expense which Sea & Ski will not compensate
for any towing charges.
20.
Water Potability
Rental Properties have
varying water quality and are different than most guests are
accustomed to drinking at home. Sea & Ski advises guests to use
bottled water for consumption during occupancy.
21.
Campers/Motor Homes/Tents
Campers, motor homes or
the use of tents on rental property is prohibited. If there is
evidence of the use of these items will result in the loss of
your security deposit.
22.
Gas Grills and Charcoal BBQs
Properties that include
gas or charcoal grills provide gas tanks and cooking surface
only. Gas and charcoal must be provided by guest. Sea &
Ski will provide a list of local filling stations. Outdoor
cooking is allowed, but only in approved grills. ALL cooking
surfaces must be left clean by guest upon departure to avoid
extra cleaning charges.
23.
Hot Tubs
If a hot tub or pool is
provided at the Rental Property, it will be prepared and tested
for proper and safe chemicals prior to or on the day of
occupancy. Misuse of tub/pool by the spilling of foreign
substances into the pool, i.e. Soap, shampoo, oils, glass or
metal will result in a $500 Service Call Charge. Under no
circumstances are pets allowed in pools or hot tubs. Violation
of this provision shall be grounds for expedited eviction and
the loss of security deposit. The hot tub cover must remain on
the hot tub at all times when not in use in the event of damage
to the cover due to the renters negligence will be charged
$400-$600 for replacement or to have it repaired. Sea & Ski
Vacation Rentals or any of their affiliates are not responsible
for any type infections associated with the use of hot tubs/jacuzzi’s.
Pathogens commonly found in hot tubs can cause: septicemia,
urinary tract infections, intestinal infections, infections of
the respiratory tract, bacteremia, endocarditis,
gastroenteritis, Legionnaire's disease, Pontiac fever, impetigo,
folliculitis, furuncles, carbuncles, scalded skin syndrome,
toxic shock syndrome, food poisoning, pneumonia, empyema,
osteomyelitis, and septic arthritis.

Campfires
Must be controlled and
contained and adhere to county laws and restrictions. These laws
and restrictions will be provided in the property binder for
each property. No explosives or other combustible material
(aerosol cans, fireworks, etc) is allowed in any fire pit
evidence of the use of these items will result in termination of
rental agreement and the loss of the security deposit.

Motorized Boats
Every operator (under
the age of 20) of a motorized boat on Canadian waters must have
a SAFE OPERATOR CERTIFICATE. We require a legible copy of this
certificate on file at least 2 weeks before for your rental. If
this is not provided, the cottage owner will be notified, and
the motor for the boat will be removed for the duration of the
rental, with no refund applicable. It is the operator's
(renter's) responsibility to obtain the certificate, and to know
the rules of safe boat operation. The occupant shall ensure that
each person in the boat is wearing the proper PFD (life jacket),
sized according to each person's age and weight. This is
required for all boaters. For more information on your legal

26.
Mechanical and Appliance Failure
Sea & Ski will use its
best efforts to have mechanical (water, septic, electrical and
plumbing) and appliance failures corrected as soon as possible,
but cannot control the scheduling of outside service
contractors. No Refunds will be made for appliance or
mechanical failures or breakdowns. Tenant will be charged for
unnecessary maintenance and service calls or repairs caused by
abuse beyond normal wear and tear. NO refunds will be made for
malfunction of appliances or other equipment.
27.
Community Rules/Regulations
Some individual
communities and associations have rules and regulations that
become part of the guests Terms and Conditions. Community rules
that apply are provided to tenant at check-in or may be
requested prior to occupancy
28.
Liability
Guest(s) hereby agree to
hold and save harmless Sea & Ski Realty Ltd., Brokerage and Sea
& Ski Property Management, their employees, and the property
owner from damages or injuries to personal property by reason of
any cause whatsoever, either in or about the occupied property
or elsewhere.
29.
Guest Responsibility
The guest whose name
appears on the lease is responsible for all terms and conditions
set forth in this document for them, their guests or others they
may have visiting or staying at the vacation rental property
during their term of occupancy. Failure to comply any of the
terms and conditions will result in loss of security deposit and
possibly other charges that result in violation of the rental
agreement, incomplete or incorrect information.
30.Violation
of Terms or Conditions of Occupancy
When guest(s),
violate any of the terms of occupancy, property rules, community
rules or regulations, the guest may be asked to vacate the
property by Sea & Ski and no refund will be given due to
the guest. And will result in the loss of the security deposit.
I/ We
__________________ have read and understood the terms and
conditions detailed (please print)
in the above
document. I agree to follow Sea & Ski Property Managements terms
and conditions and understand that failing to do so will result
in my eviction from the property stated in the rental agreement
signed by myself and I am responsible for the terms of
occupancy, property rules, community rules or regulations and
any guests to the property while I am a tenant. I understand
that any violation of these terms and conditions will result in
the termination of my rental agreement and the loss of my
security deposit.
